If Train is Late Travellers Can Get Compensation 10 Times of Fare

A passenger named Arun Kumar Jain has successfully taken the Indian Railways to a consumer forum over a train delay, highlighting the potential for compensation for affected travelers. On March 11, 2022, Jain was traveling from Jabalpur to Delhi on a special train scheduled to depart at 3:30 PM and arrive at Hazrat Nizamuddin station at 4:10 AM the next day. However, the train was delayed by three hours, which caused Jain to miss his connecting train to Dehradun that was set to leave at 6:45 AM.

Case Filed in Jabalpur Consumer Court

In response to the inconvenience caused by the delayed train, Arun Kumar Jain filed a case against the Railways in the Consumer Forum of Jabalpur. The Railways defended itself by citing fog and technical faults as reasons for the delay; however, they failed to provide any evidence to substantiate these claims. The lack of proof resulted in the Consumer Court ruling in favor of Jain, who argued that the delay was unjust and resulted in the cancellation of his onward journey.

Decision in Favor of the Passenger

The Consumer Court ordered the Railways to compensate Arun Kumar Jain with a total of ₹ 7803, which includes the ticket amount of ₹ 803, ₹ 5000 for mental distress, and ₹ 2000 for litigation expenses. The Railways has been instructed to pay this amount within 45 days, and failure to do so will incur an additional 9% interest. This case serves as a reminder that railway passengers facing delays can seek redress through consumer forums, especially when such delays are unjustified.
