Delhi Consumer Commission penalizes Indian Railways for downgrading passenger ticket without notice

The Delhi State Consumer Disputes Redressal Commission has issued a significant ruling against Indian Railways, holding the national transporter accountable for ‘deficiency in service’ following an unnotified ticket downgrade. The case centers on a passenger who was left without a confirmed berth or RAC status after a coach was withdrawn from his train at the last minute, forcing him to endure a long-distance journey while standing. Details of the Incident and Legal Battle

The ordeal began on October 31, 2012, when Saroj Kumar Singh, a resident of Uttam Nagar, Delhi, arrived at Anand Vihar Railway Station to board the Simanchal Express. Having booked an RAC-43 sleeper class ticket, he expected a smooth journey to Katihar Junction. However, upon checking the final reservation charts, he discovered his status had plummeted to WL-44. This change was necessitated by the sudden removal of a coach for technical reasons. Because the Railways failed to inform him of this change, he was left with no option but to stand for the entire duration of the trip.

Following the incident, Singh sought justice through the consumer court. On March 11, 2020, the District Consumer Disputes Redressal Commission ruled in his favor, ordering the Railways to pay Rs 5,000 as compensation for the mental agony caused and the associated litigation expenses.

Commission Rejects Railways Appeal

The Ministry of Railways and Northern Railway challenged this order, arguing that an RAC (Reservation Against Cancellation) ticket does not technically guarantee a confirmed berth. However, on February 27, 2026, the State Commission, led by President Justice Sangita Dhingra Sehgal and member Bimla Kumari, firmly rejected this stance. The Commission observed that while the Railways may have technical reasons for coach removal, the failure to provide timely intimation to the passenger regarding the change constitutes a significant deficiency in service. This ruling reinforces the rights of railway passengers and confirms that the Railways cannot evade responsibility for lack of communication regarding service changes.
