A recent ruling by the Consumer Commission has highlighted the accountability of Indian Railways regarding passenger grievances. An elderly couple, Parthasarathi and his wife Nirmala K.T., were unable to access their reserved sleeper class seats on the Kanyakumari-Pune Express (Train No. 16382) on December 10, 2023, as unauthorized passengers occupied their berths. Despite their son, Aditya T.P., filing multiple complaints via the Rail Madad app, the issue remained unresolved, leading the family to seek legal recourse.
Key details of the incident and regulatory changes:
- The Consumer Commission ordered Indian Railways to pay ₹50,000 as compensation for deficiency in service.
- This follows a similar case where an elderly couple was awarded ₹75,000 after being forced to sleep on the floor due to overcrowding.
- The minimum fine for ticketless travel was increased to ₹500 effective July 1, 2026, under the Jan Vishwas Act.
- Unauthorized entry into women’s coaches now carries a penalty of up to ₹2,500, which can double if the case reaches court.
Strengthening Passenger Rights and Safety
Indian Railways is actively working to curb the menace of unauthorized travel in reserved compartments. The recent legal precedents underscore that a confirmed ticket is a guarantee of service, and the carrier is responsible for ensuring that reserved passengers can occupy their allotted seats without hindrance. The failure to address complaints filed through the Rail Madad portal was a significant factor in the Commission’s decision to penalize the railway administration.
New Measures to Improve Travel Experience
To enhance passenger discipline and comfort, several systemic changes have been implemented. Aside from the increased fines for ticketless travel, the reservation process has seen updates, such as the first reservation chart being prepared 8 hours before departure. Additionally, to improve the quality of travel for those with confirmed bookings, RAC passengers are now entitled to a full bedroll kit in AC coaches, a policy effective from August 7, 2026. These measures are part of a broader initiative to ensure that the rights of genuine, ticket-holding passengers are protected and that the overall travel experience on the Indian Railways network remains safe and orderly.
